Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Noble Rewards mobile app, the website at noble-portal.com, and the loyalty program they run (the "Service"), operated by Noble ("we," "us," or "our"). By creating an account or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service, and at least 18 to redeem rewards on your own behalf. Fleet sign-up is reserved for the operator of a commercial fleet account.

2. Guest access

You can browse outlet locations, wash sites, and the rewards catalogue without creating an account ("Guest Mode"). In Guest Mode we process only anonymous technical data needed to run the app. Creating an account is only required to use account-based features: earning points, redeeming rewards, the membership card, and your profile.

3. Your account

• You are responsible for maintaining the confidentiality of your password and for all activity under your account.
• Notify us immediately at jfrisbie@noblegasct.com if you suspect unauthorised access.
• One account per person. Multi-account fraud is grounds for termination and point forfeiture.

4. Earning points

• Points are awarded for qualifying fuel purchases at Noble Gas stations, identified through the Gilbarco Passport point-of-sale at the pump. Points are worth 100 points = $1, earned at 1 point per $1 on fuel and 2 points per $1 on in-store and car-wash purchases.
• Your tier is based on trailing-12-month spend and sets your earn multiplier and per-gallon fuel discount: Bronze earns 1x points with a 3¢/gal discount; Silver (~$1,500 trailing 12 months) earns 1.25x points with a 5¢/gal discount; Gold (~$4,000 trailing 12 months) earns 1.5x points with a 10¢/gal discount.
• Points typically post to your balance within seconds. In the event of a network outage, the pump will queue the event and reconcile it on the next connection.
• Points carry no cash value and cannot be sold, transferred, or combined between accounts. Points expire after 12 months of account inactivity.
• If a transaction is reversed at the pump, the matching points are reversed and a "Points Reversed" notice is shown in your account.
• Referral bonuses are capped at 10 referrals per rolling 30-day period.

5. Redeeming rewards

• Available rewards are listed under Benefits and Rewards. Tier-specific rewards require you to be at or above the stated tier.
• Car-wash SmartCodes expire 7 days after issuance (or sooner, per the TTL displayed on the code screen, whichever is shorter). Unused or expired codes return your points automatically.
• Armed fuel-discount rewards apply at the pump on your next qualifying fill within the validity window. If the pump declines or the reward expires, no points are deducted.
• Reward availability, point cost, and validity windows may change without prior notice.

6. Payments

The Service does not process payments and does not collect payment card information. Fuel, in-store, and car wash purchases are completed at the pump or point of sale, outside the Service. Any car wash membership billing is handled by the DRB car wash operator at the kiosk, not in the app.

7. Acceptable use

You agree NOT to:

• Reverse-engineer, decompile, or tamper with the Service.
• Use bots, scripts, or automated means to interact with the Service.
• Attempt to defraud the loyalty program (for example, redeeming points from cancelled transactions, fabricating fuel purchases, or sharing accounts to multiply rewards).
• Use the Service to violate any law, infringe any right, or harass another user.

8. Fraud and suspension

We may suspend or terminate any account, and forfeit unredeemed points, if we have reasonable grounds to believe the account has engaged in fraud, abuse, or material violation of these Terms. Where lawful we will notify you of the action and the basis for it.

9. Termination and account deletion

You may close your account at any time from Profile → Delete account in the app, or at noble-portal.com/account-deletion. Closing your account permanently removes your personal data; audit rows are retained in pseudonymised form for compliance.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Noble disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, neither Noble nor its officers, employees, or affiliates shall be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability is limited to the greater of (a) the value of points you have earned in the prior 12 months or (b) USD 100.

12. Apple App Store

If you downloaded the app from Apple's App Store, this section also applies and takes priority over any conflicting term above:

• This agreement is between you and Noble only, not Apple, and Apple has no obligation to furnish any maintenance or support for the app.
• Your license to use the app is limited to a non-transferable license to use it on an Apple-branded device that you own or control, as permitted by the App Store Terms of Service usage rules.
• In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any, to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights.
• You represent and warrant that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce these Terms against you as a third-party beneficiary.
• The Android build of the app is distributed through Google Play and is additionally subject to the Google Play Terms of Service.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced in the app and the effective date at the top of this page will be updated. Continued use of the Service after a change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. Disputes shall be resolved exclusively in the state or federal courts located in Hartford County, Connecticut.
